Foot Locker Downtown Throwdown Three-Point Contest Promotion
1. The Contest
1.1 These Terms & Conditions govern the conduct of the Foot Locker Downtown Throwdown Three-Point Contest Promotion. Your participation means that you accept these Terms & Conditions. Please read these carefully prior to participating in Foot Locker Downtown Throwdown Three-Point Contest.
1.2 The Contest offers an opportunity for selected participants to participate in the Foot Locker Downtown Throwdown Three-Point Contest
1.3 The winners of each regional event, will then have the chance to participate at the Final event in London on XXX January 2016 and compete for the grand prize to win a trip to Toronto to watch the 2016 NBA All-Star Game.
1.4 No purchase is necessary to enter.2. Eligibility
2.1 The promotion is open to residents of UK, Spain, and Germany, except employees of the Promoter; the “NBA Entities,” which includes the National Basketball Association (the “NBA”), the NBA Member Teams, NBA Media Ventures LLC, NBA Properties, Inc. and its affiliates; any of its subsidiaries, agents or any other business involved with the administration of this promotion, or members of the households of such employees. Entrants must be resident in the country from which they submit their entry. Entrants must be 18 years of age to enter the competition.3. The Competition
3.1 Participants will compete at Preliminary Rounds three-point events for the chance to win a trip to London for two to compete in the Downtown Throwdown Final in January 2016. The winner of the Downtown Throwdown Three-Point Contest Final will win a trip to Toronto for the 2016 All Star Game.
3.2 To enter, participants must participate in their local Downtown Throwdown Preliminary Rounds
3.3 Preliminary Rounds competition. Participants must sign up at www.footlocker.co.uk/en/content/nba to secure their spot for the chance to participate in the Preliminary Rounds event

Participants can register for the Preliminary Rounds online between 27 November 2015 and 12 December for Madrid, between 27 November and 14 December for Berlin and between 27 November January 7th
for London via www.footlocker.co.uk/en/content/nba; or showing up at the location on the day of the Preliminary Rounds event organised in the Country of residence.
3.4 The participant must fill in a registration form on www.footlocker.eu or at the Foot Locker activation area at the event to confirm their entry to participate in the competition. Amongst all registered entries a maximum of 75 participants will be allowed to participate at each event.
3.5 The Foot Locker Downtown Throwdown Three-Point contest at the Preliminary Rounds will consist of selected participants, that will be given the opportunity to participate at their regional Foot Locker Downtown Throwdown (Three-Point Contest).
3.6 In case of a tie during the Preliminary Rounds selection, each participant with the same score will shoot another 5 ball rack for a one off tie shooting. In case the participants are still tied, this will be repeated until one participant has the better score.
3.7 The winner from each Preliminary Round will win a trip for two to London, UK, two tickets to the NBA Global Game on 14 January and will be eligible to participate in the overall Final to be hosted in London, UK in January 2016 (“the Final”).
3.8 The winners of the Preliminary Rounds plus his/her guest must have a valid passport/ID and must be compliant with any provisions of local Laws to enter their country of residence. Promoter shall not be liable if the winner and/or his/her guest is/are refused admittance to the UK
3.9 The Final: The Final will take place in London in January 2016, where each of the pre-selected winners (from the three Preliminary Rounds competitions) will attempt to make as many three-point shots as possible from five positions behind the three-point arc in one minute. The pre-selected winner with the highest number of points will win a trip for two to Toronto to watch the 2016 NBA All-Star Game. In case of a tie, each participant of the final with the same score will shoot another 5 ball rack for a one off tie shooting. In case the participants are still tied, this will be repeated. The best participant of the final from the one off ties shooting will win the prize of a trip to Toronto.
3.10 The winner of the final plus his/her guest must have a valid passport and must be compliant with any provisions of Canadian Law to enter into Canada. The Promoter shall not be liable if the winner and/or his/her guest is/are refused admittance to Canada.3 The Prize
4.1 The prize for the winners of the preliminary event from each Preliminary Rounds event consists of 1 X 2 tickets to London for the winner to take part in the Downtown Throwdown Three-Point Contest Final in London in January 2016 (winner will be notified of the exact date by Foot Locker). The prize covers return flights (economy class) for 2 people from any major international airport in Europe, two tickets to the NBA Global Game in London on 14 January 2016 and hotel accommodation for two people for 2 nights in London. Food, drink, travel insurance and spending money are not included as part of the prize. If the Winner is a minor, guest must be minor’s parent or legal guardian. The guest cannot be a minor. Value of prize: 1,000 Euros per winner. Prize cannot be substituted for cash.
4.2 The prize for the winner of the Foot Locker Downtown Throwdown Three-Point Contest Final consists of 1 x 2 tickets to NBA All-Star 2016 in Toronto (winner will be notified of the game date by Foot Locker). The prize covers return flights (economy class) for 2 people from any major international airport in Europe and hotel accommodation for two people for 2 nights in Toronto. Food, drink, travel insurance and spending money are not included as part of the prize. If the Winner is a minor, guest must be minor’s parent or legal guardian. The guest cannot be a minor. Value of prize: 2,500 Euros.
4.3 In the event of non-availability of the prize for any reason, the Promoter reserves the right to substitute the prize with a prize of a similar nature. No cash alternative will be available. The prize is not transferable.
4.4 Except in the event of negligence, fault or deliberate acts or omissions on the part of the Promoters or their agents, the Promoters do not accept responsibility in case of loss or damage or injury to the winners or their property and/or baggage caused or suffered in connection with the competition, the prize, or the travel and lodging.4 Winners
5.1 The winners from the Preliminary Rounds will be selected based on points scored at the Foot Locker Downtown Throwdown Three-Point contest at each of the Downtown Throwdown Three-Point Europe events.
5.2 The winner from the Final will be selected based on points scored at the European Foot Locker Downtown Throwdown Three Point Contest Final in London in January 2016.
5.3 Winners of Preliminary Rounds of the Foot Locker Downtown Throwdown Three-Point contest and the Winner of the Final will be notified on site. In the event that one of the winners does not wish to accept the prize they must advise the Promoter on the spot and without delay. If winners reject the prize they will forfeit the prize and no substitute or alternative will be available.5 Miscellaneous
6.1 All visa and health costs related to the travel shall be supported by the winner.. To the maximum extent permitted by the law, the Promoter and NBA Entities shall not be liable for any claims or actions of any kind whatsoever for damages or losses to persons and property which may be sustained in connection with the receipt ownership and/or use of the prizes. This limitation of liability is a comprehensive limitation of liability that to the maximum extent permitted by law applies to all damages of any kind, including (without limitation) direct, indirect, or consequential damages; loss of data, income, or profit; loss of damage to property; and claims of third parties. Participants agree that the Promoter and NBA Entities have not made nor is in any manner responsible or liable for any warranty, representation, or guarantee, statutory, express or implied (including but not limited to, the implied warranties of merchantability, title and fitness for a particular purpose), in fact or in law, relative to the competition. Without limiting the generality of the foregoing, NBA Entities do not make any express or implied warranties or representations with respect to the Promoter website and the Promoter and NBA Entities shall not be liable for the consequences of any interruptions or errors related thereto in the event of negligence, fault or deliberate acts or omissions on the part of the Promoter or its agents, the promoter and the NBA Entities do not accept responsibility for any entries lost, damaged, corrupted, delayed, quarantined, or not received by the promoter, whatever the cause; and the Promoter and the NBA Entities are not responsible or liable for any technical, hardware, software, server, website, or other, failures or damage of any kind. The Promoter’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. The Promoter reserves the right to disqualify Participants who violate these Official Rules. If a participant is disqualified, the Promoter reserves the right to terminate the Participant’s eligibility to participate in the Competition.
6.2 In the event that, due to the acts or omissions of winner(s), the Promoter is unable to deliver the prize to the winner, that winner will forfeit the prize and no substitute or alternative will be available. No substitute winners will be selected.
6.3 Except in the event of negligence, fault or deliberate acts or omissions on the part of the promoter or its agents, the promoter does not accept responsibility for any prizes lost, damaged, delayed, or not received by the winner, whatever the cause, and will not replace such prizes.
6.4 Entrants may be required to participate in advertising or promotional activity for the Promoter, without payment. In addition, the Promoter and the NBA Entities will have the right, at their absolute discretion and without payment or permission to the participant to use the winners’ video, pictures, name, region of residence for related promotional purposes.
6.5 You hereby agree that Promoter shall be entitled to use such pictures, name, region of residence and that this information and/or these images may be posted on Promoter’s website or any website operated by any affiliated company of the Foot Locker group, or used in any other media for marketing or other business purposes, without compensation or prior approval by the entrants. Promoter shall have all rights related to such images and their use.6 These rules
7.1 The Promotion instructions are available on site and on www.footlocker.co.uk/en/content/nba. Entrants, who do not comply with these rules, will not be eligible to enter the Promotion. By participating in the Qualifying Preliminary Rounds, entrants agree to be bound by these rules.
7.2 In the event of obvious error in these rules, illegality, or circumstances beyond the reasonable control of the Promoter which prevent the administration of the Promotion, the Promoter reserves the right to amend these rules or withdraw the Promotion. The Promoter will not be liable for any form of loss or disappointment caused by same. In such circumstances the Promoter will make all reasonable endeavours to advise entrants of any changes or withdrawal.
This promotion is void where prohibited by local laws. 7 Personal Data
8.1 By entering the Promotion, entrants consent to Foot Locker, the NBA Entities and their respective agents, associated companies, and subsidiaries storing and processing entrants’ personal data for the purpose of: carrying out this promotion; analysing effectiveness and response to the promotion; and for market and quality control analysis. Such processing will include the transfer of entrants’ data from the entrant’s country of residence to the promoter’s agents in the United Kingdom.
8.2 All entrants give hereby, by means of participating in the Foot Locker Downtown Throwdown Three-Point Contest competition give their consent to the use of this data.
The Promoter shall not be liable for any failure to comply with its obligations caused by (but not limited to) weather conditions, fire, flood, strike, hurricane, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, or any other circumstances beyond the control of the Promoter.
No responsibility is accepted for entries lost, damaged or delayed or as a result of any network, computer hardware or software failure of any kind. The Promoter and any affiliated companies are not responsible for any entry, generated by computer hardware or software, malfunction, error or failure.
The winner and their guest must abide by any relevant terms and conditions which form part of their prize. Whilst at the event, you must not: be drunk, intoxicated, under the influence of drugs, underage, be abusive, threatening, make or incite racial abuse, chant, use offensive language, make obscene gestures, throw items, behave anti-socially, carry laser pens, bring animals (except guide dogs), carry offensive weapons or illegal substances, climb any structure or offer any item for sale. You consent to be filmed and/or photographed at the event. Failure to comply with these Terms and Conditions may result in refused entry, or the ticket holders being required to leave the event.
Prizes are non-transferable, non-refundable and there is no cash alternative. In the event for any reason the prize winner does not take an element of the prize at the time stipulated by the Promoter, then that element of the prize will be forfeited by the winner and neither cash nor any other form of compensation will be supplied in lieu of that element of the prize. However, the Promoter reserves the right to provide an alternative prize of equal or greater value in the event of unforeseen circumstances.
If for any reason the event is not capable of running as planned, such as cancellation or any other cause beyond the control of the Promoter which affects the running or conduct of this promotion, the Promoter may in its sole discretion cancel the prize and not re-award any additional tickets to the winner or reimburse any incurred expenses by the winner as a result of winning or accepting the prize.
If for any reason the Promotion is not capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the promotion.
If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation.
Winners may be requested to participate in reasonable publicity arising from the promotion.
